These Ticket & Travel Customer Service Conditions are the terms on which UNIM8 Limited will provide a transport and entry service, and these conditions shall apply to each ticket and travelling passenger. Any person who travels with the T&t service shall be considered to have agreed to these T&t Customer Conditions of Service.
1. DEFINITIONS
In interpreting these Terms and Conditions, the following words shall have the following meanings:
1.1. "We", "Us" and "Our" refers to UNIM8 Limited, registered in England and Wales number 5472894, and whose registered office is at 73 The Boulevard, Worthing, West Sussex, BN13 1JT.
1.2. “T&t” and “Ticket & Travel” refers to the ticket & transport service which combines tickets with an event, activity or show with organised passenger transport.
1.3. ‘TicketM8.co.uk’ means the online ticketing system wholly owned by UNIM8 Limited; with the web address http://www.ticketm8.co.uk.
1.4. “Coach” means the coach, bus or vehicle used to carry you when travelling.
1.5. "Journey” means each journey made as part of your entitlement as a T&t travelling passenger.
1.6. "Luggage” means any property which you bring onto a coach, which includes any property carried on your persons or on any part of a journey.
1.7. "You" means the individual person who we have agreed to carry or arranged to be carried, being the person who purchased a ticket or for whom a ticket was purchased for.
1.8. "Ticket” means the Ticket or Ticket Code which sets our agreement to carry or arrange for the carriage of any passenger.
1.9. “Coach driver” is the responsible driver(s) who is supplied on behalf of a coach operator for the purposes of transporting customers.
2. THE TICKET & TRAVEL SERVICE
2.1. Agreement of service. We agree to provide the T&t service to carry you and your luggage on a journey as granted by your ticket, on and subject to the terms and conditions detailed in the Ticket & Travel Customer Service Conditions.
2.2. Your ticket. Your ticket is a record of our agreement to supply you with the T&t, ticket and transport service. If your ticket was purchased by someone else on your behalf, you agree that such person purchased the ticket and acted on your behalf and that that person then becomes your agent and is your responsibility to ensure that all ticket details are correct at all times. The ticket may only be used by the person named as the ticket holder and is subject to the purchasing terms as set by the approved T&t ticket outlet.
2.3. The transport. The transport is supplied by local area Coach Operator(s) using executive coaches with seat belts and experienced drivers. A typical coach will include a toilet, onboard entertainment and undercarriage storage; subject to availability. We make no guarantee to the minimum features of a vehicle. All coaches will apply a strict non-smoking policy. Consumption of any alcohol is to the discretion of the coach operator. In the case of a coach breakdown, the coach company will supply a support coach to operate the remainder of the journey (whether incoming or outgoing). The safety of you as a passenger and the relevant insurance in doing so will be covered by the Coach Operator who is responsible for the vehicle.
2.4. Minors and young persons. We will not be obliged to provide the T&t service to any person under the age of 14 years unless that child is accompanied by a responsible person. Any booking made for a person under the age of 14 will be taken as confirmation that the child will be under the supervision of a responsible person aged 18 years or older. The responsible person will be required to purchase their own Ticket, unless expressed on the booking page. We will not be held responsible if a child is turned away for not having a responsible adult at the venue, nor will the ticket price be refunded.
2.5. Seat reservations. We are unable to reserve and book specific seats on a vehicle for any journey. We can however inform the coach leader or driver of any special requests based on health requirements; which can be made upon request by emailing us with the further details. We make no claim or guarantee that a particular seat on a coach will be assigned to you at any time.
2.6. Undersubscribed services. In the case that a service becomes unsubscribed or is at risk of being cancelled for any reason beyond our control, we may with reasonable notice, by returning in full the money paid and without further or other liability – cancel the service. This payment will only be given back to the individual who placed the booking and made payment for the initial ticket; of whom is responsible for the reimbursement to the ticket holders who own subsequent ordered tickets.
2.7. Responsibility of luggage. Luggage is carried entirely at the owners risk and we cannot be held responsible for loss or damage to such; this also includes any property or equipment left on service vehicles. You must pack items of luggage safely, securely and conveniently at all times in a way to protect your luggage from loss or damage and may be asked directly to securely fasten or pack items which may be deemed fragile. It is your responsibility to look after your luggage at all times, except where any luggage is stored in the coach hold. It is your responsibility to see your luggage put on and taken on off the coach.
2.8. Maximum luggage. You are granted to take onto a service one or two medium size suitcases or rucksack and one small hand luggage. Any passenger bringing more than this allowance will not have additional luggage carried with the travel. Hand luggage is defined as something which can be stored in overhead luggage space or under a coach seat. We shall have no obligation to carry luggage in excess of the granted amount. We may agree to allow additional luggage, subject to available space and if items are packed in a purposeful manner.
2.9. Prohibited luggage. We have no obligation to carry prohibited luggage and you may not bring them onto any service vehicle without our written permission. Prohibited luggage includes weapons, drugs, animals, battery-powered vehicles, non-folding items or any items which at the reserved discretion of the coach driver is considered unsafe or may cause injury or damage to property. Any prohibited items will be removed and left outside the vehicle with no further liability to you.
2.10. Small valuable items. Small valuable items should be taken onboard the coach as hand luggage and should not be left unattended by you and where possible be carried on your persons. Such items include money, medication, jewellery, laptop computers, personal electronic devices, travel or identification documents.
2.11. Lost Luggage. Any luggage left behind shall be stored in a location deemed appropriate by the coach driver who shall take reasonable care of such luggage at your own risk. We and the coach driver reserve the right to open and examine any lost luggage to identify dangerous or unsuitable to store items. Any uncollected luggage remaining after two weeks from the date of receipt may be disposed of in a manner we deem appropriate. Any lost property you find which belongs to another person travelling must be handed to the coach driver immediately.
2.12. Food and Drink. You are welcome to bring onboard the coach hot drinks, provided they are fitted with a safety lid to avoid spillage, non-alcoholic drinks and cold food.
3. YOUR RESPONSIBILITIES
3.1. Accurate ticket details. As a passenger travelling on a T&t service you must check that the all details provided with your ticket are correct and entirely accurate. Any inaccurate or incorrect details may invalidate your ticket and void your T&t service.
3.2. Provision of ticket. You must take your ticket with you at all times during the supply of the T&t service and must produce your ticket and form of photographic identification upon request by a uniformed member of UNIM8 Limited or the coach driver only. It is your responsibility to board and travel on the Coach to receive your event ticket. Customers who do not board and travel on the Coach are not guaranteed entry or admittance.
3.3. Valid ticket. You must travel with a valid ticket. You will be considered to be travelling without a valid ticket if you fail to show on request a valid ticket, travel without a valid ticket or travelling with a ticket which you are not entitled to. Should you be deemed to be travelling without a valid ticket, you will be refused any further T&t service without refund or any further obligation to you.
3.4. Fraudulent Ticket. If we have reasonable grounds to believe and consider that a ticket is obtained or used fraudulently, we reserve the right to omit the T&t service and prevent you from any or all of the T&t service. You shall not be entitled to a refund and we shall have no further obligation or liability to you.
3.5. Organiser terms. Tickets supplied by the organiser may be subject to their own terms and conditions and it is your obligation to check and adhere to any of those terms.
3.6. Pick-up and drop off. All pick-up points must be booked in advance and confirmed at the time of purchase and must be correct and accurate, at minimum, on the day of travel. All transport leaves promptly at the time stated and you agree to adhere to pick-up times and arrive at the location a minimum of 15 minutes before the scheduled departure time. You are responsible for making sure that you drop-off at the right destination and we hold no obligation or liability to you if you miss your drop-off point.
3.7. Departure. The departure terms apply for all stages of a journey where the coach departs after a stop, including but not limited to boarding points, service breaks, outgoing and return journeys. All times for any journey will be strictly adhered to and we will not compensate or refund any passengers under these circumstances. We shall not be liable to you if you miss any journey as a result of your late arrival and we shall not be obligated to hold or delay any T&t service and journey to wait for you.
3.8 Changes to departure. If a boarding point or departure time has changed, we will notify all Purchasers by phone or email. It is your responsibility to check travel details for your journey.
3.9. Journey breaks. For health and safety purposes a short break in a safe and convenient place may be made as part of a journey and is made at the reserved discretion of us or the coach driver. You must return to the coach in a timely and punctual manner within the time frame allocated for the journey break, as informed by the coach driver. The terms for departure apply here and we will not reimburse for any costs which you may incur as result of you missing the departure.
3.10. Smoking and alcohol. For the safety and comfort of passengers we operate a no smoking policy on all coaches. Where possible, at the discretion of the driver, you may use journey breaks as an opportunity to smoke. The consumption of alcohol is not permitted on the coach at any time.
3.11. Unacceptable behaviour. You shall behave in a reasonable, lawful and sensible manner at all times and comply with the requests from any member of staff. Unacceptable behaviour includes but is not limited to abusive, threatening or anti-social behaviour which may create discomfort, offend or cause potential harm to other passengers. If you behave in a manner deemed unacceptable, staff shall be entitled to restrain you, remove you from the coach and any further T&t service, cancel your ticket without refund and take any other measure which may be deemed necessary to prevent continuation of such conduct including notification to the police.
3.12. Liability over behaviour. Whilst reasonable efforts will be practiced to control the behaviour of other passengers using the T&t service, we will not be liable to you for any act or omission of any other passenger using the service.
3.13. Liability and insurance. Whilst travelling on a coach vehicle as part of the T&t service, you will be covered with the adequate and relevant insurance to enable you the transport service only. At the venue and event, it is the responsibility of the Event Organiser to ensure that all relevant insurances are obtained to enable you as a customer to participate.
4. OUR RESPONSIBILITIES
4.1. Ticket and transport service. It is our obligation to provide a travel and ticket service to ticket holders, providing transport with minimum discomfort and inconvenience and also to facilitate and manage the customer entry for the permissions and access as granted by the ownership of a valid ticket, on the terms of these Ticket & Travel Customer Service Conditions. Our service is to enable and facilitate the admission required for fulfilment of the ticketing and the transportation service. The Tickets supplied by the organiser will be subject to availability. In some cases we may batch process your ticket requirements at our discretion.
4.2. Animals. We will not carry animals or pets (other than guide dogs accompanying registered blind persons and hearing dogs accompanying deaf persons) on any of our services. In such a case, you must notify us in this instance so that we may notify and make suitable arrangements to accommodate the passenger.
4.3. Uncontrollable circumstances. We shall have no liability for any delay or failure to fulfil our service, where caused by a circumstance beyond our reasonable control and shall not be held responsible for any loss, damage or expense which comes as a direct result of strike, war, terrorist activity, fire, floods, late delivery, adverse weather, cancellation of performances, shows, sporting events or tours. We cannot be held responsible for a temporary or permanent closedown of attractions made by our suppliers. We cannot guarantee the completion of a journey within a stated time of which affected by but not limited to, traffic delays, delay-causing accidents on the service route, compliance with government officials or delays due to third parties or suppliers.
4.4. Minimum experience. Published timings are provided as a guide to the provision of the T&t service. Where due to uncontrollable circumstance which may effect the timings and itinerary to which the T&t tickets were supplied, we make only the guarantee that you will spend a minimum of four hours at the event for which the ticket grant the holder access to. Should we fail to provide a minimum of four hours at the event we will offer a full refund to ticket holders who request such a refund under these circumstances, made in writing within five working days of the ticketed date.
4.5. Refund. Ticket purchases are final. A refund cannot be made unless the T&t service has been cancelled, moved to another date or significantly changed of which you do not wish to retain your ticket to be transferred to. In the instance where you are unable to attend and use the T&t service you may reallocate your ticket to another individual if the feature is available when purchasing your ticket. Any refund made will be done so in a timely manner and only to the individual who initially purchased the ticket. If the ticket was purchased on behalf of someone, that ticket holder to which the ticket was purchased for must seek any refund amount from the purchaser. If a refund is given, then the ticket is cancelled and no further obligation is made to you under that ticket.
4.6. Luggage inspection. In complying to the conditions for carrying luggage, we hold the right to provide authority to the coach driver to inspect all luggage and hold the right to not provide the T&t service or carry your luggage if you refuse to grant us permission for such an inspection.
4.7. Service disruption. In the case of a coach being disrupted due to technical difficulties, a support coach will be supplied. In such an uncontrollable circumstance we will be responsible for organising a support coach with the capacity and ability to fulfil the remainder of the journey or journeys.
5. GENERAL
5.1. Severability. Each of the provisions in this T&t Customer Conditions of Service shall be separate and severable. Should any of these terms be invalid or unenforceable, it shall be severed from these T&t Customer Conditions of Service and the remaining provisions shall continue in full effect and be amended as far as possible to give valid effect to the intentions of those involved under the severed terms.
5.2. Changes to these terms and conditions. We reserve the right to change these terms and conditions at any time and any changes will be posted on the Website and will come in to effect immediately. You are responsible in viewing these terms and conditions periodically and before purchasing any tickets, as we cannot be responsible for any negligence on your behalf. Use of the service will be deemed consent to any such amended Terms and Conditions. If as a reflection in the update of the Terms and Conditions, you do not wish to continue with the service, contact us so that we may terminate your agreement and use of the service.
5.3. Disputes. You agree that any dispute between yourself and us which comes from your use of the service which cannot be resolved between both parties will be submitted to the exclusive jurisdiction of the English Courts. All terms and conditions in this agreement are governed by the laws of England and Wales.
